Adam J. Sklar is a member of the firm’s Litigation Department and Construction Services Group.

 

Experience

Adam has represented companies and individuals from across the country in high-stakes business litigation and construction disputes. His litigation practice is diverse and includes, in particular, representing plaintiffs and defendants, in and out of court, in contract disputes, claims of fraud, including consumer fraud, public and private construction and mechanic’s liens and payment and performance bond claims, the enforcement of judgments, federal environmental issues under CERCLA, and in employment disputes, including federal and state discrimination and whistleblower claims. He has also represented individuals in estate and trust litigation and in guardianship proceedings.

Adam has been recognized as a “Future Star” in the 2013 through 2015, and 2017 editions of Benchmark Litigation, and has earned an AV® Martindale-Hubbell Peer Review Rating. Adam is admitted in, and has litigated cases in the courts of, the states of New Jersey and New York and in the U.S. District Courts of the District of New Jersey and the Southern District of New York. He has also been admitted pro hac vice to represent parties in litigation in the states of Delaware, California and Texas.

Representative Matters

Some of Adam’s notable representations include:

  • Obtained summary judgment in favor of a large hedge fund defending against multimillion-dollar claims of fraud and breach of fiduciary duty, among other claims;
  • Obtained the dismissal of claims of personal liability against a CEO of national corporation in connection with a judgment obtained against the corporation;
  • Obtained the dismissal of tort, bond and lien claims against a New Jersey state authority in connection with a highly-publicized construction project;
  • Obtained an order invalidating a public mechanic’s lien filed by a subcontractor in connection with construction work performed at the stadium of a New York City professional sports franchise.
  • Obtained highly favorable settlements and resolutions for clients, including, but not limited to;
    • Real estate developers in disputes with their lenders;
    • Numerous contractors, subcontractors and suppliers in connection with the filing and enforcement of construction liens, mechanic’s liens and payment bond claims;
    • Property owners defending against the filing of liens against their real property; and
    • Shareholders and members of closely held businesses fighting for control of those businesses and/or alleging they have been oppressed by the majority shareholder(s).

 

Education

Adam earned his B.A., with distinction, from the University of North Carolina at Chapel Hill in 1993 and earned his J.D. from Rutgers University School of Law – Newark in 1996.

Honors & Awards

Adam has lectured on the subject of construction lien claims and other contractor and subcontractor remedies in New Jersey for the National Business Institute, West LegalEdcenter and the New Jersey Institute of Continuing Legal Education. He has co-authored practice guides in connection with those engagements, was a contributing author of the LexisNexis Practice Guide: New Jersey Commercial Litigation, and has written numerous construction-related articles that have been published in the Bergen Record newspaper, the New Jersey Law Journal, New Jersey Lawyer Magazine, the Real Estate & Construction Law Monitor and the IP Law Outlook blogs.

Adam is a member of the New Jersey State Bar Association and the Bergen County Bar Association, and the construction law sections of those associations.
