Andrew J. Roth-Moore practices corporate restructuring and litigation, with an emphasis on representing debtors, lenders, creditors’ committees, and officers and directors.
Experience
Andrew provides practical advice to leverage business opportunities and resolve challenges that bankruptcy creates. His practice is focused on negotiating and litigating complex transactions and legal disputes. He has advised clients in a wide array of industries, including, most notably, retail, healthcare and pharmaceuticals, manufacturing, oil and gas, automotive, telecom, and travel. He has navigated companies through all aspects of the bankruptcy process, including section 363 sales, plan confirmations, contract negotiations, and claims resolutions.
Andrew’s restructuring practice is paired with his superior litigation skills. He regularly litigates in federal trial courts and appellate courts and represents clients in mediation. He is called upon for his ability to resolve complex issues, including valuation fights, bankruptcy jurisdiction disputes, breach of fiduciary duty claims, and tax matters.
Andrew has led company-wide restructurings, including, most recently, Advantage Rent-a-Car and nSpire Health, Inc. He has represented secured lenders in highly-contested, bet-the-company litigation and in acquiring debtor businesses, including the recent, multi-week valuation trial for Chesapeake Energy Corp. the bankruptcy-acquisition of Vivus, Inc.
Prior to his current role, Andrew served as a judicial clerk for the Honorable Laurie S. Silverstein of the United States Bankruptcy Court for the District of Delaware.
