With thirty-two years of legal experience in the fields of patent litigation, commercial litigation, and licensing, including proceedings before the Patent Office, Brian Carpenter has appeared in at least four hundred cases, the majority of which were patent cases.

EXPERIENCE

A staunch advocate with business savvy, Brian advises clients on how to best protect and monetize their intellectual property assets. Through careful execution of the law, Brian guides clients through issues involving all forms of IP, including patents, trademarks, copyrights, licensing, and protecting IP assets through corporate transactions.

Additionally, Brian’s practice spans outside the world of IP law to include general commercial litigation. He regularly advises on cases involving breach of contract, antitrust, trade secret, unfair competition and other business torts.

Willing to go where he is needed, Brian has been significantly involved in cases in courts across the nation, including the Eastern and Northern Districts of Texas, District of Delaware, Northern District of California, District of Colorado, District of Utah, Southern District of Florida, Eastern District of Michigan, and District of Massachusetts.

Brian has tactile technical experience gained from his former career as an engineer for the Southwest Research Institute in San Antonio, Texas. He is naturally interested in technology, and so has gained extensive knowledge on a broad range of technologies ranging from complex digital electronics and computer architectures to less complex mechanical devices.

He has also received a Certified Information Privacy Professional (“CIPP”) certification through the International Association of Privacy Professionals (“IAPP”), further equipping Brian with the tools needed to successfully provide counsel on issues related to data privacy and cybersecurity.

Examples of these technologies include:

  • computer chips and architectures
  • semiconductor manufacturing
  • networking devices and protocols (the 802.x family, TCP/IP, Bluetooth)
  • telecommunications systems (3G and 4G/LTE)
  • materials (metallurgy and polymers)
  • data storage
  • gas turbines
  • robotics
  • cameras
  • medical imaging technologies
  • high voltage power transmission
  • electronic packaging
  • satellite set-top box TV receivers
  • GPS devices

Representative Matters:

  • Successfully resolved numerous patent litigations, including a jury trial, with positive results for VIA Technologies, Inc., a chipset and microprocessor manufacturer.
  • Represented Brookstone, over a period of seven years, in a variety of intellectual property matters, including the negotiation of a creative solution to end multiple litigations between Brookstone and Sharper Image.
  • Represented Gateway, Inc. through trial in the District of Utah in a case concerning an Input/Output controller chip.
  • Successfully resolved numerous patent litigation matters for StoneAge, Inc., an employee-owned company that manufacturers rotary hydraulic tools.
  • Negotiated a creative three-party agreement that resolved over ten years of litigation in favor of client and patent owner, Fischer Imaging Corp., a manufacturer of medical imaging devices, which received $32 million.
