Intellectual Property and Litigation Associate Arjun Nair is a versatile litigator who advises clients of all sizes throughout all phases of a case – from drafting and discovery to strategy, trial work and appeals.  

EXPERIENCE

Arjun assists clients across a broad range of intellectual property and commercial litigation, with a focus on complex patent litigation in federal courts. His clients include small startups and large multinational corporations. His recent representations include plaintiff and defense side patent litigation involving IOT technology, wireless telecommunications, doorbell cameras, and multi-sensor systems. Outside of patent litigation, Arjun also has experience with trademark litigation before the TTAB, and bankruptcy litigation involving preferential transfers before federal bankruptcy courts.

Arjun has experience in all phases of litigation from due diligence and complaint drafting to trial and appeal. For patent cases, he specializes in the technical side, including infringement contentions, claim construction, motion practice, fact and expert discovery, expert witness preparation and deposition, expert reports, and expert witness direct and cross examination.

Arjun also has an active pro bono practice. He has experience litigating on behalf of clients who suffered assaults and abuse rooted in racial bias.

Prior to joining Cole Schotz, Arjun was a judicial intern to U.S. District Court Judges Karen Gren Scholer and Jane J. Boyle in the Northern District of Texas. He also served as an Articles Editor on the Texas A&M Law Review.

Representative Matters

• Plaintiff’s counsel in a patent infringement case against a national security company in the Eastern District of Texas in which the jury awarded $45 million in damages.
• Plaintiff’s counsel in a patent infringement case against a multi-national camera and avionics company involving patents related to portable video cameras.
• Counsel for the trademark applicant and owner in opposition and cancellation proceedings before the Trademark Trial and Appeal Board.
• Plaintiff’s counsel representing a litigation trust in preferential transfer bankruptcy litigation case against an international company that resulted in a favorable settlement.
• Plaintiff’s counsel in a pro bono assault/hate crime case against a party that later pled guilty to assault and terroristic threat charges with hate crime enhancements.

Publications

Arjun writes on a variety of current legal issues including the interplay of AI and patent law, and international trade law and intellectual property law implications of the COVID-19 vaccine race. His law review publications have been widely viewed and commented on by practitioners and shareholders.
