Cole Schotz Secures Victory Before the New Jersey Supreme Court In Cannabis Dispensary Land Use Matter

Cole Schotz P.C. secured a victory in the New Jersey Supreme Court on behalf of their client, Blue Violets LLC. The matter at issue involved complex, novel, and nuanced issues of municipal land use law in the State. The New Jersey Supreme Court’s decision marks a victory for Blue Violets LLC, a cannabis dispensary, in retaining its rights to open and operate a micro cannabis dispensary in Hoboken, NJ. 

The New Jersey Supreme Court listened to an appeal which challenged the firm’s earlier landmark victory in 2024, which had established new law in the State of New Jersey. The appeal sought to void Blue Violet’s land use approvals. In a unanimous decision, the State’s highest Court dismissed the appeal in its entirety, leaving the Appellate Division’s ruling undisturbed and preserving the victory for Cole Schotz and its client, Blue Violets.

Cole Schotz member Michael Klauder argued the matter on behalf of Blue Violet in front of the New Jersey Supreme Court on March 3. The case is Hoboken for Responsible Cannabis, Inc. and ElizabethUrtecho v. City of Hoboken Planning Board and Blue Violets LLC, case number 64718-0002.
