Zachary is an associate in the Real Estate Department and a resident of the New York office.

 

Experience

Zach represents a range of clients in complex commercial real estate transactions, including lenders and borrowers in real estate finance transactions, as well as owners, operators, developers and investors in all phases of commercial real estate deals from inception to closing.

Prior to Cole Schotz, Zach was a judicial intern for the Honorable Gregory H. Woods of the United States District Court for the Southern District of New York.

 

Representative Matters
LENDER-SIDE FINANCING
    • Represented the lender in connection with a $25 million loan facility to fund the construction and development of a water park adjacent to the Showboat Casino in Atlantic City, NJ. The completed project will include a water park, entertainment centers, gift shops, parking lots, and various food and beverage facilities.
    • Represented the lender in connection with a $32.5 million loan facility to fund the construction and redevelopment of the historic Jacob Riis Park Bathhouse in Far Rockaway, Queens. Plans for the property include the renovation and redevelopment of the property into a boutique hotel with approximately 27 rooms, multiple unique concept food and beverage outlets, beachfront concert venue, outdoor pool and cabanas and private beach club.
    • Represented the lender in connection with a $20.5 million loan facility to fund the development and construction of a three-story building with 69 residential units, 130 parking spaces and rooftop amenities.
    • Represented the lender in connection with a $69 million loan facility to refinance the property and fund the conversion of two senior living facilities into 212 multifamily rental units (with a portion designated as affordable housing units) with 210 parking spaces and shared amenities in White Plains, New York.
    • Represented the lender in connection with a $284 million construction loan facility in connection with the ground-up construction of a 76-unit, 26-story, 412,362 gross square foot, sail-shaped luxury residential condominium.
    • Represented the lender in connection with a $43 million loan facility in connection with refinancing and construction of a to-be-developed eight unit, for-sale luxury condominium building with grade level retail space in downtown Manhattan.
ACQUISITIONS AND BORROWER-SIDE FINANCING
  • Represented the purchaser/borrower in connection with a $200 million acquisition, financing and redevelopment of approximately 438,000 square feet of condominium units comprising the former Hudson Hotel in Columbus Circle.
  • Represented the purchaser/borrower in connection with the acquisition and financing of a mixed-use property located at 1289 Lexington Avenue/141-155 East 86th Street, which is comprised of a residential condominium tower known as The Hayworth, and a ground leased commercial component.
  • Represented the owner/borrower in connection with its joint venture and refinancing of an existing $29.5 million loan facility on the property, which included negotiating restructuring of aspects of long-term lease and sublease with a New York not-for-profit charter school.
  • Represented the buyer/borrower in connection with its acquisition of the property located at 1370 Broadway, New York, NY for $75.25 million. Simultaneously negotiated the closing of a $72 million loan to finance the acquisition and renovations of the mixed-use building containing approximately 279,000 rentable square feet of office and retail space.
  • Represented the buyer/borrower in connection with its acquisition and financing of the office building located at 1375 Broadway, New York, NY for $170.4 million. In connection with the acquisition, simultaneously negotiated the restructuring of the existing $165 million loan from note-on-note financing to a direct mortgage loan.
  • Represented the buyer/borrower in connection with its acquisition and financing of the office building located at 292 Madison Avenue, New York, NY for $84 million.
  • Represented the buyer/borrower in connection with its acquisition of a portfolio of 11 properties located in Hamilton Township, NJ and Vestal, NY. Simultaneously negotiated the closing of a $63.35 million mortgage loan from Argentic Real Estate Investment and an $11 million mezzanine loan from AION Partners to fund the acquisition and development of certain multifamily properties in the portfolio.
  • Represented the borrower in connection with a $69 million loan from Voya Investment Management LLC to refinance the Atlantic Center Mall located at 625 Atlantic Ave, Brooklyn, NY.
SALES AND DISPOSITIONS
  • Represented the seller in connection with the disposition of 24 properties to Ellis Equities, LLC. The buildings contained 1,326 multifamily rental units in Brooklyn and Manhattan for an aggregate purchase price of $172.35 million.
Education

Zach received a Juris Doctorate, cum laude, from New York Law School in May 2021. During law school, Zach’s academic achievements included Dean’s List, Dean’s Leadership Council, Dean’s Academic Scholarship recipient, Teaching Fellow for the Academic Success Program and Student Attorney for the Post-Conviction Innocence Clinic.

Prior to law school, he received a bachelor’s degree in psychology, with minors in writing and rhetoric, from Colgate University. While at Colgate, Zach played NCAA Division I Varsity Football as a wide receiver. Well adept at catching a play and pushing it ahead, he employs the same forward moving momentum to his legal practice.
