Arielle Wasserman is an associate in the Litigation department. Her practice includes all aspects of commercial litigation, with a focus on real estate.

EXPERIENCE

Prior to joining Cole Schotz, Arielle was at Wilk Auslander, where she gained significant drafting and discovery experience representing domestic and international corporations, hotels, commercial landlords, co-operative boards, and individuals in state, federal, and appellate courts. Her practice focuses on disputes and investigations involving high-stakes commercial matters, including contractual disputes, all variety of business and financial litigation, SEC investigations, and securities fraud. She has practiced both real estate and construction litigation, often focusing on sophisticated real estate transactions as well as alternative dispute resolution. In addition to actively representing clients in state and federal court, she has been involved in domestic and international arbitration. Arielle has previously:

  • Drafted all manner of legal documents, including all variety of pleadings and successful dispositive and procedural motions, i.e., summary judgment motions, motions to dismiss, discovery motions, discovery requests and responses, settlement agreements, and mediation statements.
  • Argued motions, taken depositions, prepared witnesses for deposition and trial testimony, and managed all aspects of discovery.
  • Collaborated substantially with clients to assess litigation risks, devise and implement litigation strategies, and provide input on case budgets.
  • Supervised project teams handling high-stakes and time-sensitive matters, including supervising teams of paralegals and outside contract attorneys.
  • Prepared responses to subpoenas, document requests, and requests for information, drafting formal submissions to regulators, and preparing and defending business personnel in depositions.
  • Advised commercial landlords and tenants in navigating Covid-related legislation and litigation, including bringing actions to recover for rent, use and occupancy, ejectment and/or eviction options, and default judgments.
Representative Matters

A selection of Arielle’s recent case highlights includes:

  • Represented former limited liability company member in action to recover rescissory damages stemming from breach of fiduciary duty, mutual mistake, and fraudulent misrepresentations. Limited liability company was initially formed to acquire and redevelop real property (now worth ~56 million) in Claymont, Delaware.
  • Represented whistleblower in U.S. Tax Court in action to recover a billion-dollar award pursuant to 26 USC § 7623.
  • Successfully represented a majority noteholder and former corporate officer in federal securities fraud action.
  • Successfully represented commercial landlords against Icon-controlled single-purpose garage entities in a variety of actions to recover rent via alter ego liability and/or void fraudulent transfers pursuant to NYDCL 273- a and 274.

Honors & Awards

Arielle was named one of the 2019 Outstanding and Next Generation of Women Builders by the Women Builder’s Council. She has been published in the 2018 Lexpert/American Lawyer Guide to the Leading 500 Lawyers in Canada, as well as by the American Bar Association.
