Construction disputes are as prevalent as ever, and litigation is often the means to resolve them. Far from run-of-the-mill, construction disputes present unique challenges which are only magnified depending on whether the matter is being resolved in court, or in arbitration. Oftentimes, the selection between court or arbitration is made well before the dispute arises, through forum selection/ alternative dispute resolution provisions in the controlling contract. This decision is often made without a full appreciation of the key differences between the two forums and how they impact the construction dispute. This webinar will provide an overview of litigation in both venues with an emphasis on key distinctions between them, and will examine important considerations and best practices in both forums, from the pleading stage through to hearing or trial.
