Description: The COVID-19 pandemic has caused significant disruption in the hotel and hospitality industry and a significant number of hotel owners and operators have sought Chapter 11 bankruptcy protection during the pandemic. This CLE presentation will explore a number of key legal considerations for hotel owners, operators, franchisors and attorneys assisting the hotel industry in navigating times of financial distress.

Topics will include whether a hotel filing constitutes a single asset real estate case under the bankruptcy code, considerations in managing and transitioning franchise agreements in bankruptcy, franchisor protections, section 363 sales and valuation disputes, lease rejection and potential damages and the role of lenders in appointing a CRO or other management team in hotel bankruptcies. Among other cases, the recent Eagle Hospitality and San Jose Fairmont chapter 11 cases will be used as case studies.
