Ayala brings sound business judgement and legal insight gained from extensive expertise in representing Fortune 500 companies, financial services companies, banks, and other creditors in the creditors’ rights and litigation arena, both as in-house counsel and at law firms.

Prior to joining Cole Schotz, Ayala served as senior counsel for a global information technology company and had a proven track record of mitigating risk and maximizing recoveries in the state, federal, and bankruptcy & insolvency arenas. She supported the company’s global credit & collections, business units, procurement, and all global functions in all aspects related to credit, collection, and insolvency of customers, resellers, distributors, vendors, landlords, tenants, and other debtors involving significant IT contracts, license agreements, equipment leases, wind energy agreements, real estate leases, secured transactions, reseller agreements, distribution agreements, and other IT and commercial contracts in virtually all industries and all phases of the domestic and cross-border corporate bankruptcy and financial restructuring or liquidating process.

She represented the company’s interests as creditor in hundreds of corporate bankruptcy cases including notable cases such as Hertz, JC Penney, Avianca, LATAM, Absolute, AGPB, Birch (Fusion), Weatherford International, Sears Holdings, Sears Canada, Stearns Holdings, Tops Holding, Bon-Ton Stores, Puerto Rico, Westmoreland Coal, Cobalt Energy, Westinghouse Electric, Corinthian Colleges, Energy Future Holdings, Cengage Learning, Exide Technologies, AMR Corporation (American Airlines), Delta Airlines, NewPage, Borders Group, Integra Bank, Mesa Air, R.H. Donnelley, Reader’s Digest, Chrysler, Chemtura, Delphi, ResCap, OSG, Aveos, Avaya, Saab, Ultimate Electronics, WaMu, SunEdison, Standard Register, City of Detroit, and General Motors.

Previously, Ayala served as senior counsel in the commercial litigation department of a multi-national technology services company where she handled matters, either as lead or substantive co-counsel, and at times representing the company as Chapter 11 creditors committee member, involving significant IT outsourcing contracts, airline reservations and flight plan services contracts, real estate leases, personal property leases, airplane leases, license agreements, and other IT and commercial contracts in domestic and international corporate bankruptcy and financial restructuring proceedings such as Delphi Automotive, MCI WorldCom, Enron, US Airways (both cases), United Airlines, Delta Airlines, Continental Airlines/System One, ATA, Northwest Airlines, Aloha Airlines (both cases), TWA, America West Airlines, Frontier Airlines, Alitalia, Tower Air, ANC (National Car Rental), Wickes Furniture, Collins & Aikman, Tower Automotive, SIRVA, Bethlehem Steel, LTV Steel, Stelco, National Steel, Adelphia, Arch Wireless, Exide, Foamex, KMart, Lechters, NexInnovations, Peregrine, Safety Kleen, Solutia, and Eastern Airlines.

She also handled commercial litigation matters representing the company and its subsidiaries, as lead or as part of a team, in all phases of commercial litigation including informal and formal dispute resolution, discovery, motion practice, trial, appeal, oral arguments before The United States Court of Appeals for the Fifth Circuit, arbitration proceedings, mediation, and internal investigations related to FCPA allegations, whistleblower allegations, and in response to SEC inquiries.

Earlier in her career, Ayala worked in the Dallas and Houston offices of a national corporate law firm representing secured creditors and trustees in many high-profile bankruptcy matters and in lender-liability litigation during the S&L crisis. She was lead Chapter 11 counsel for a manufacturing company, through successful plan confirmation and emergence from bankruptcy, and she regularly represented Chapter 7 trustees in a multitude of bankruptcy cases.
