Program Description:
This program will explore the development and current state of law imposing environmental liabilities on parent corporations, shareholders, officers and successors. We will discuss the triggers that cause courts to pierce the corporate veil or find an entity or individual to be an “operator” and assign liability. We will evaluate the tension between the environmental statutory schemes that are remedial and far reaching in nature and the long held common law corporate principles that evolved to protect against liabilities.
