Mark Politan concentrates in the practice areas of insolvency, business reorganization, creditors' rights and bankruptcy litigation. Mr. Politan regularly represents Chapter 11 and 7 debtors, creditors' committees, asset purchasers, commercial landlords, secured creditors and other parties in interest in all aspects of bankruptcy and insolvency proceedings.
Mr. Politan is a frequent contributor and panelist for the NJ Bankruptcy Bench Bar Conference and has served as a speaker for an NJ ICLE seminar on the "New" Bankruptcy Code. Mr. Politan has also led in-house seminars on changes to the Bankruptcy Code for clients and other professionals.
After receiving his law degree, Mr. Politan clerked for the Honorable Donald J. Volkert, Jr., P.J.S.C. during the 1998-1999 term.
Representative Matters
- Represent PBI Regional Medical Center, a non-profit, general hospital, as debtor-in-possession in its Chapter 11 proceeding in the U.S. Bankruptcy Court for the District of New Jersey.
- Represent the Official Committee of Unsecured Creditors of Kara Homes, Inc. and its affiliates, a prominent home builder, in Chapter 11 proceedings in the U.S. Bankruptcy Court for the District of New Jersey.
- Represented the Official Committee of Unsecured Creditors of Treasure Island, Inc., a retailer of home goods and furnishings, in Chapter 11 proceedings in the U.S. Bankruptcy Court for the District of New Jersey.
- Represented the Liquidating Trustee for Native Nations Securities, Inc., a Jersey City based broker-dealer, in Chapter 7 proceedings in U.S. Bankruptcy Court for the District of New Jersey.
- Represented the Liquidating Trustee for Broadway Trading, LLC and its affiliates, securities brokerage firms, in Chapter 11 proceedings in U.S. Bankruptcy Court for the Southern District of New York.
- Represented the Official Committee of Unsecured Creditors of AIC Corp., a construction firm, in Chapter 11 proceedings in the U.S. Bankruptcy Court for the District of New Jersey.
- Represented the Official Committee of Unsecured Creditors of Reynolds Bros., a retailer of women’s clothing, in Chapter 11 proceedings in the U.S. Bankruptcy Court for the District of New Jersey.
- Represent the Liquidating Agent for PHP Healthcare Corp. in Chapter 11 proceedings in the U.S. Bankruptcy Court for the District of Delaware.
- Represented several commercial landlords in Chapter 11 proceedings of Levitz Furniture in the U.S. Bankruptcy Court for the Southern District of New York.
- Represented a leading manufacturer of private label detergents and laundry aids in successful out-of-court composition, restructuring and sale of assets, avoiding formal bankruptcy proceedings and providing distribution to unsecured creditors.
- Represented Heller & Usdan, a paper converting company, as debtor-in-possession in its Chapter 11 proceedings in the U.S. Bankruptcy Court for the District of New Jersey.
- Represented court-appointed receiver for insolvent watch distributor and wholesaler in receivership proceedings in the Superior Court of New Jersey, Passaic County.
- Represented secured creditor in the Chapter 11 proceedings of Collins & Aikman in the U.S. Bankruptcy Court for the Eastern District of Michigan.
- Represented leading insurance company in the Chapter 11 proceedings of Omne Staffing, Inc. and its affiliates in the U.S. Bankruptcy Court for the District of New Jersey with regard to various workers’ compensation policies and litigation with the Chapter 11 Trustee.
- Represented numerous parties in defense of avoidance actions in bankruptcy cases including Kmart, Enron, Factory 2-U and Levitz Furniture, pending in various jurisdictions including the Northern District of Illinois, Southern District of New York and the District of Delaware.
