Leo Leyva chairs Cole Schotz's Litigation practice in its New York office. His practice emphasizes complex commercial litigation and corporate reorganization. 

Upon graduation from Rutgers Law School, Mr. Leyva served as law secretary to the Honorable Arthur J. Lesemann, Chancery Division, Superior Court of New Jersey. Since joining Cole Schotz in 1989, Mr. Leyva has litigated numerous complex commercial matters in the federal and state courts in both New York and New Jersey and a significant number of complex adversary proceedings in the bankruptcy courts.

Noteworthy

Mr. Leyva has been awarded an AV rating for his professionalism and the quality of his legal work from Martindale-Hubbell, the premier directory of legal professionals, and has been selected by his peers as a New Jersey Super Lawyer in Business Litigation.

Representative Matters

Mr. Leyva has represented and continues to represent numerous clients in the state and federal courts in both New York and New Jersey in matters involving corporate dissolution, shareholder oppression, contract claims and directors & officers liability, as well as real estate-related litigation matters. He has tried numerous cases to conclusion in both state and federal court.  His clients include Palisades Regional Investment Fund, Ritchie Capital Management, GTS Holdings, Inc. (Empire International, Ltd and CLS Worldwide Services).

In the bankruptcy arena, Mr. Leyva has represented debtors such as Hit or Miss Inc. (national retailer with over 200 locations), as well as clients in major proceedings such as United Health Care Systems, Inc., in the largest healthcare Chapter 11 proceeding in the history of New Jersey; Totowa Metal Fabricators, Inc. and Delta Management Systems, Inc. He has also represented clients in major bankruptcy proceedings such as Grand Union Supermarkets, Inc., Bradlees Stores, Inc., Casual Male Corp. (Big and Tall Shops, Inc.), The Finova Group, Inc. and Loew's Cineplex Entertainment Corp.

Publications

Mr. Leyva is  the co-author of the chapter on "Assignment for the Benefit of Creditors," assisted in the preparation of "Receivers for Corporations" for the 1995 West Publishing New Jersey Practice Series, in addition to having a number of articles published in the New Jersey Law Journal and Bergen Barrister.  He was featured in an April 30, 2008 article in the Star-Ledger entitled Debt Marks the Spot: Opportunity Funds Convert Trouble into Treasure.  He has also lectured on various insolvency-related topics.
