Jamie Clare concentrates his practice in complex litigation. His experience includes federal and state court matters involving construction disputes, director and officer liability, surety, commercial transactions, unfair competition and employment disputes in the trial and appellate courts. Mr. Clare also practices in the areas of chancery litigation for individual and corporate clients, and in arbitration matters.
Mr. Clare has considerable experience in surety & fidelity bonding and construction litigation in the New York and New Jersey state, federal and bankruptcy courts. His experience includes appeals; construction reorganization and workouts; mediation and arbitration of subcontractor, supplier and owner bond claims; public bidding law protests and appeals; litigation, arbitration and mediation of surety indemnification and subrogation claims. Mr. Clare has also drafted and negotiated letters of credit and collateral security agreements; acted as claims counsel for a construction surety in run-off; managed all phases of claims litigation and work-out in payment and performance bond matters; drafted and negotiated takeover, completion and work-out agreements; and filed and litigated construction liens.
Mr. Clare was a judicial intern to the Honorable James T. Murphy, J.S.C., Superior Court of New Jersey, and served as an aide to the California Local Government Commission through the office of California State Senator Thomas Hayden in Sacramento. Upon graduation from law school, he began his practice in commercial and maritime litigation in San Francisco. He returned to New Jersey in 1994, practicing commercial employment and insurance defense litigation. He joined Cole Schotz in the Litigation Department in 2001.
Mr. Clare has spoken at seminars focusing on payment and performance bonds, restrictive covenants and employment termination.
