Nicholas J. Brannick is a member in the firm's Bankruptcy and Corporate Restructuring and Litigation Departments. Nick focuses his practice on general litigation and corporate disputes and corporate restructuring matters, including representing debtors, creditors committees and parties in adversary proceedings.  Nick has worked with clients in several industries, including agriculture, aviation, retail, software and commercial real estate.  He has also represented first lien lenders, liquidating agents and WARN Act defendants in bankruptcy cases as well as Chapter 7 trustees.

Nick has served as lead or co-counsel in a number of complex bankruptcy cases.  His significant debtor representations include:

  • American Cadastre, L.L.C.
  • Rubicon U.S. REIT, Inc
  • Eos Airlines, Inc.
  • Eurofresh, Inc.
  • Zounds, Inc.
  • Curtis Papers, Inc.

Nick’s committee representations in Chapter 11 proceedings include:

  • EnviroSolutions of New York, LLC
  • Mesaba Aviation, Inc.

Nick has also represented parties in contract disputes in Delaware’s Chancery Court and Superior Court.  
Recent engagements include:

  • Successfully defending a real estate development company in a $4.9 million contract dispute.  See Miller v. National Land Partners, LLC, 2014 WL 2601378 (Del. Ch. Jun. 11, 2014) aff’d 2015 WL 849692 (Del. Feb. 26, 2015).
  • Representing the plaintiff in a dispute involving a multi-million dollar family business before the Delaware Chancery Court.
