David Kohane is a member of the firm’s Litigation Department, founded and chairs the firm’s Intellectual Property Department, and co-chair’s the firm’s Information Governance and Discovery Services Practice Groups. David concentrates his practice in several areas of complex litigation and regularly handles disputes and provides counseling in the areas of trademarks, copyrights, patents, trade regulation, unfair competition, environmental, tax disputes, defamation and privacy rights, with special focus on the protection, use and misuse of intellectual property rights in the digital age. He was an early leader in the field of electronic discovery, assisting clients in navigating this difficult area cost-effectively. He also has a depth of experience handling white-collar criminal and constitutional matters, along with commercial and construction disputes and litigation under the securities, antitrust and RICO laws. David handles matters at the trial and appellate levels, in administrative proceedings and in mediations and arbitrations. He has served as an arbitrator in both international and domestic matters.

David has authored numerous articles in the fields of trademark law, copyright law, Internet and computer law, electronic evidence and discovery, evidence, federal civil procedure, federal tax disputes, criminal law, civil rights and RICO. He lectures frequently in the fields of intellectual property law and disputes, Internet and computer law, evidence and court procedure.

Awarded an AV rating for his professionalism and the quality of his legal work from Martindale-Hubbell, the publisher of the premier directory of legal professionals.  David has also been included in New Jersey Super Lawyers from 2009 to 2015. No aspect of this advertisement has been approved by the Supreme Court of New Jersey. David was selected as co-director of the John C. Lifland American Inn of Court, 2011. The Inn concentrates on practice in the federal courts and intellectual property law. He serves on the Online Use Committee of the International Trademark Association on the Committee on Trademarks & The Internet of the American Bar Association’s Intellectual Property Section and on the Federal Practice Committee of the New Jersey State Bar Association.

David served as law clerk for the Hon. Charles S. Haight, Jr. in the U.S. District Court for the Southern District of New York in Manhattan before entering private practice. He earned his B.A. from Wesleyan University, magna cum laude, and his J.D. from New York University Law School, cum laude and Order of the Coif.
