David Kohane is an experienced litigator who founded and co-chairs the firm’s Intellectual Property Department. He is known for his creative approach to counseling and dispute resolution and is often asked to strategize in situations where litigation is anticipated and there exists a need to get in front of the issues. He was an early leader in the field of electronic discovery, assisting clients in navigating this difficult area more cost-effectively.
David’s experience spans several practice areas, including trademarks, copyrights, patents, trade regulation, unfair competition, environmental, antitrust, tax disputes, and defamation and privacy rights. He has extensive experience prosecuting trademark and copyright registrations and in the protection, use and misuse of intellectual property rights in the digital age. In the environmental realm, David both litigates and plays an active role in dispute resolution between private parties and government agencies. He handles matters at the trial and appellate levels, in administrative proceedings and in mediations and arbitrations.
David has authored numerous articles and spoken on topics in the fields of trademark law, copyright law, environmental law, Internet and computer law, electronic evidence and discovery, evidence, federal civil procedure, federal tax disputes, civil rights and RICO. In service to the profession, David served as co-director of the John C. Lifland American Inn of Court from 2011-2015. The Inn concentrates on practice in the federal courts and intellectual property law. He currently serves on the Emerging Issues Committee of the International Trademark Association and on the Committee on Trademarks & The Internet of the American Bar Association’s Intellectual Property Section.
David served as law clerk for the Hon. Charles S. Haight, Jr. in the U.S. District Court for the Southern District of New York in Manhattan before entering private practice. He earned his B.A. from Wesleyan University, magna cum laude, and his J.D. from New York University Law School, cum laude and Order of the Coif.
